1. Who We Are
Agent Ellemotion (operated by Brent Bernard trading as ellemotional, ABN 43 432 414 727, Gold Coast, Queensland, Australia) is a human–AI hybrid creative studio. Every product we sell — whether ready-made or custom — is produced using generative AI tools under direct human direction, review, and final approval. A human being decides what is created, curates every output, edits and finalises every file, and approves every listing before it is published or sold. AI is our production tool. It does not make final creative or business decisions.
2. Full Disclosure: Everything You See Is AI-Generated
To be completely transparent: every character, figure, object, creature, scene, and depiction of a person shown in our artwork, product designs, and marketing — including anything that looks human — is entirely AI-generated and fictional. This includes but is not limited to characters, mascots, cartoon or animated figures, stylised creatures, and any imagery resembling animals, dinosaurs, eggs, or people. None of these depict a real, living person, a real animal, or any real entity. Any resemblance to an actual person is coincidental and unintended. We do not photograph, film, or use real human models, real photography of people, or likenesses of real individuals in our product artwork.
3. Our Service Model
We offer both print-on-demand and digital download products built using AI-generated artwork, design, text, and supporting formats. For custom and commissioned orders, we use AI tools guided by the client’s brief to research, draft, and produce a design suited to that client’s specific request, with our own creative direction and final human editing applied throughout. Whether you are purchasing a ready-made product or commissioning custom work, AI assistance is used somewhere in the production process, and a human reviews and finalises the result before delivery.
4. Why We Disclose This
We want anyone who views, purchases, or is told about our work to know clearly and in advance: we use AI to help us create, produce, and sell our products, and to help build and run this website and our custom design service. We are open about this because transparency builds trust, and because several jurisdictions where our customers live have introduced specific disclosure expectations for AI-assisted content. This page exists to meet those expectations in one clear, easy-to-find place, in addition to the disclosures on individual product listings and platforms.
5. Photorealistic Imagery and Deepfake Disclosure (EU Customers)
Under Article 50(4) of the EU AI Act (Regulation (EU) 2024/1689, transparency obligations effective 2 August 2026), a business selling AI-generated content into the EU must visibly disclose any AI-generated image, audio, or video that resembles a real or plausible person, place, or event closely enough that it could reasonably be mistaken as authentic. As stated above, we do not depict real people. Where any of our artwork is photorealistic in style and depicts a plausible-looking person or place, we treat this as falling within that disclosure duty and label it as AI-generated at the point of sale, in addition to this statement. Clearly stylised, decorative, cartoon, or fantastical artwork (which is the majority of what we produce) does not require this specific label, but is still covered by the general AI disclosure on this page and on our AI Content Policy.
6. California AI Transparency Act (CAITA / SB 942)
California’s AI Transparency Act (SB 942, as amended by AB 853, operative 2 August 2026) places direct obligations on “covered providers” — generative AI systems with over one million monthly users accessible in California, such as the underlying AI platforms we use as tools. As a sole trader using third-party AI tools, we are not a covered provider under this law and have no direct watermarking obligation. Where the AI tools we use embed provenance data such as Content Credentials (C2PA) or SynthID in their output, we do not strip or remove that metadata.
7. Australian Consumer Law
Under the Australian Consumer Law (Competition and Consumer Act 2010, ss 18 and 29), we must not engage in misleading or deceptive conduct or make false representations about our goods and services — including through AI-generated product descriptions or marketing copy. All AI-assisted written content is reviewed by a human for accuracy before publication. We do not overstate what our AI tools or products can do, and we do not present AI-generated statistics, testimonials, or claims as fact.
8. Content Provenance (C2PA / Content Credentials)
Where the AI tools we use attach Content Credentials (the C2PA provenance standard) or a similar verifiable watermark such as Google SynthID to generated files, we preserve that metadata through our production process wherever technically possible. This is provided by the AI tool provider, not created by us, and is not present on every file, as not all tools support it and some platforms strip it automatically.
9. Where You Will See This Disclosure
This statement applies across every platform we sell on, including this website, our Etsy shop, and our Gumroad store at ellemotion.gumroad.com. On Etsy specifically, our listings are attributed as “Designed by seller,” disclose AI assistance in the listing description, and set production details in line with Etsy’s Creativity Standards. On this website, product pages carry the same disclosure. If you notice a listing anywhere that is missing this disclosure, please let us know and we will correct it.
10. Internal Compliance Practice
We keep an internal record for each product covering the AI tool and model used, the nature of our creative input, whether the content is photorealistic or depicts a person, and where disclosure has been applied across each platform. This record is kept for our own compliance purposes and is not published, but demonstrates our good-faith approach to these obligations.
