Our Use of AI
Agent Ellemotion (ABN 43 432 414 727) uses AI-assisted tools to help design, draft, and produce some of the digital products, content, and services offered on this site, and to help build and maintain this website itself. This policy explains how we use AI and what that means for you as a customer.
How AI Is Used
- Drafting and formatting written content and templates
- Generating design elements, layouts, images, or supporting graphics
- Assisting with research and product development
- Assisting with building, editing, and maintaining this website
All AI-assisted output is reviewed and refined by a human before publication or sale. AI is a production tool we use — it does not make final decisions about what is published or sold.
Third-Party AI Image and Content Generation
Some images and content used in our products may be generated using third-party AI tools and hosting providers. In these cases, the generation itself occurs on infrastructure operated by that third-party provider, under that provider’s own terms of service and content policies. We select and review outputs before use, but we do not control the underlying AI model or hosting infrastructure of third-party providers, and cannot guarantee outputs are free from their own limitations or errors. If you believe any content on this site was generated inappropriately, contact us at admin@ellemotional.com and we will review it.
Accuracy
While we take reasonable care to review AI-assisted content for accuracy, AI tools can make mistakes. If you notice an error in a product or on this site, contact us at admin@ellemotional.com and we will correct it.
No Harmful or Deceptive Use
We do not use AI to create content that is deceptive, infringes on others’ rights, or that depicts or facilitates harm to any person, including minors. See our Online Safety & eSafety Commitment for more.
Environmental Considerations
We recognise that AI systems require significant computing power and energy, and can generate heat and strain hardware if not run in a properly controlled environment. Where we operate our own AI infrastructure, we take reasonable steps to run it responsibly. Where we use third-party AI providers, we rely on those providers to operate their infrastructure safely and within applicable environmental and safety standards.
No Real People, Animals, or Entities Depicted
Every character, figure, object, and depiction of a person or creature in our artwork and product designs, including anything that looks human, animal, or otherwise real, is entirely AI-generated and fictional. This includes characters, mascots, and stylised figures resembling animals, dinosaurs, eggs, cartoons, or people. We do not use real human models or photography of real individuals. EU AI Act Article 50 (Deepfake Disclosure)
Under Article 50(4) of the EU AI Act (Regulation (EU) 2024/1689, effective 2 August 2026), sellers must visibly disclose AI-generated images, audio, or video that resemble a real or plausible person or place closely enough to be mistaken as authentic. Where our artwork is photorealistic and depicts a plausible-looking person or place, we label it as AI-generated at the point of sale. Stylised, cartoon, or fantastical artwork, the majority of what we produce, falls outside this specific requirement, but is still covered by our general AI disclosure.
California AI Transparency Act (CAITA)
California’s SB 942 (as amended by AB 853, operative 2 August 2026) places watermarking and disclosure-tool obligations on “covered providers”, generative AI systems with over one million monthly Californian users. As a sole trader using third-party AI tools, we are not a covered provider and have no direct obligation under this law. Where our AI tools embed provenance data such as Content Credentials (C2PA) or Google SynthID, we preserve it rather than strip it.
Australian Consumer Law
Under sections 18 and 29 of the Australian Consumer Law, we must not engage in misleading or deceptive conduct or make false representations about our goods and services, including through AI-generated descriptions or marketing copy. All AI-assisted written content is reviewed by a human for accuracy before publication.
Marketplace Disclosure
Where a specific marketplace (such as Etsy) requires AI-use disclosure on a listing, that listing will carry its own disclosure in line with that platform’s policy, on Etsy this includes “Designed by seller” attribution and the relevant production fields, in addition to this page. The same applies to our Gumroad store at ellemotion.gumroad.com.
